Spoil Piles and the 2-Foot Setback

Hazards: Spoil or equipment rolling into the excavation · Wall failure under the surcharge load of a pile · Loose rock falling from the face · Mobile equipment tracking too close to the edge

Why it matters

The pile at the lip is two hazards at once: it rolls in on you, and its weight pushes the wall in. CPWR's May 2024 Data Bulletin puts 1926.651(j), protection from loose rock or soil, at 13.7% of all trenching citations from 2011 to 2023 — the fourth most-cited trenching standard.

MIFACE report 05MI084 (2005): a 30-foot sewer trench in a back yard, 6 to 9 1/2 feet deep, sides close to vertical. The yard was small and a fence was in the way, so the spoil went on the edges of both sides. The wall and part of the sidewalk came in on a 24-year-old worker, who died; the owner was buried alongside him. MIOSHA cited the 2-foot spoil rule and the missing protective system. During the rescue, investigators noted the spoil was still too close.

Key points

  • Two feet, minimum. 1926.651(j)(2): materials and equipment go at least 2 feet back, or behind a retaining device, or both.
  • Equipment counts. Excavator, pipe, compactor, truck, generator. If it can fall or roll in, the rule covers it.
  • Two feet is a floor, not a design. App. B (c)(3)(iii): with a surcharge load from stored material, equipment or traffic, the competent person has to cut the slope back below the maximum allowable slope. The pile changes the math.
  • "No room" is not an exception. Subpart P has none. Haul it off, use a retaining device, or set a box.
  • A retaining device has to actually retain. (j)(2) says sufficient to prevent material from falling or rolling in — not a 2x4 on edge.
  • Piles creep. Every bucket, every rehandle, every pass of the loader moves the toe closer. It was compliant this morning; check it now.
  • Scale the face or barricade it. (j)(1): loose rock and soil in the face get removed, or barricaded to stop and contain falling material.
  • Rain runs downhill. A pile at the lip funnels surface water straight into the trench, and wet spoil weighs more than the pile you set.
  • Blind machines near the edge get a spotter. 1926.651(f): barricades, signals or stop logs when the operator cannot see the edge.

  • Plan where spoil goes before the first bucket.
  • Walk the toe of the pile the whole run.
  • Say something when a machine parks at the lip.

Don't

  • Treat 2 feet as the goal on a 10-foot pile.
  • Stack pipe or plate on the far side "just for a minute."
  • Work under a face with loose material hanging in it.

Yes. 1926.651(j)(2) covers excavated or other materials or equipment that could fall or roll into the excavation. An excavator, a stack of pipe, a compactor and a truck are all covered.

Not necessarily. 2 feet is a minimum, not a design. Under Subpart P Appendix B (c)(3)(iii), when surcharge loads from stored material, equipment, operating equipment or traffic are present, a competent person must determine how much the actual slope has to be cut back below the maximum allowable slope, and make sure it happens.

There is no exception for a tight lot. Haul the material off, use a retaining device, or use a shield system. A congested site is a reason to plan the spoil, not to skip the setback.

1926.651(j)(1) requires protection from material that could fall or roll from the face — scaling to remove the loose material, barricades on the face to stop and contain it, or equivalent means.
