2.1 PPE basics and the hierarchy of controls

Personal protective equipment is the last thing standing between a hazard and a person, which is exactly why it is the least reliable control on the site. It only works if it is the right item, if it fits, if it is worn correctly every single time, and if it has not quietly failed. This chapter puts PPE where it belongs in the hierarchy of controls, then covers who selects it, who pays for it, and what changed in the construction PPE rule at the end of 2024.

1 The hierarchy of controls

NIOSH describes hazard control as a hierarchy, ordered from most effective to least: elimination, substitution, engineering controls, administrative controls, and finally PPE. The order is not a preference. Each step down transfers more of the burden of staying safe from the workplace onto the individual worker, and people are the least dependable part of any system at 4:30 on a Friday.

    Eliminate. Prefabricate the assembly on the ground so nobody has to work at height. The hazard no longer exists.

    Substitute. Use a water-based product instead of a solvent-based one; use a smaller, quieter compressor.

    Engineering controls. Guardrails, machine guards, a trench box, local exhaust ventilation, wet cutting on a masonry saw. The hazard is still there; the control keeps it away from people without their cooperation.

    Administrative controls. Rotating workers out of a hot area, sequencing trades so nobody works underneath, restricting a swing radius, training and permits. Depends on everyone following the plan.

    PPE. Hard hat, glasses, gloves, boots, hearing protection, respirator. Depends on one person, every minute, with no margin for a bad day.

Real jobs use several levels at once, and that is correct: you cut concrete wet and wear a respirator. What is not correct is jumping straight to the bottom of the ladder because it is the cheapest step. If the answer to a dust problem is only "wear a mask," someone skipped four better answers.

Common mistake: writing "PPE required" in the control column of a job hazard analysis and stopping there. PPE is a control against the residual hazard, not against the hazard you never tried to remove. If you build JHAs, our JHA/JSA builder keeps the hierarchy in front of you while you write.

2 Who decides, who pays

The framing rule for construction PPE is 29 CFR 1926.95(a): protective equipment for eyes, face, head and extremities, protective clothing, respiratory devices, and protective shields and barriers shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary because of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants. 29 CFR 1926.28(a) puts the duty on the employer to require the wearing of appropriate PPE wherever there is exposure to hazardous conditions.

Payment is settled by 1926.95(d)(1): PPE used to comply with Part 1926 must be provided by the employer at no cost to employees. There are narrow exceptions, and it is worth knowing them so you can tell a legitimate one from a bad habit:

And if you bring your own gear, 1926.95(b) makes the employer responsible for assuring that it is adequate, properly maintained and sanitary. Your own dusty half-mask from a previous job is not automatically acceptable.

3 Fit is now in the standard

On December 12, 2024 OSHA amended the construction PPE rule, and the new paragraph 29 CFR 1926.95(c) states that employers must ensure all personal protective equipment is of safe design and construction for the work to be performed, and is selected to ensure that it properly fits each affected employee.

That second clause matters more than it looks. Ill-fitting PPE is not a comfort issue; it is a protection issue. Safety glasses that sit away from the face let grinding sparks in from the side. Gloves too large catch on rotating parts. A harness sized for a much larger worker allows the D-ring to shift and lets a person slip in a fall. Fall protection, hi-vis vests and coveralls sized only for average male frames leave many workers on site protected on paper and unprotected in practice. If the gear you were handed does not fit, that is a legitimate request for different gear, not a personal preference.

On the job: a five-point fit check before the shift — hat suspension snug and level, glasses touching the brow with no gap at the temples, gloves with no loose cuff near rotating parts, boots laced to the top, harness leg straps tight enough that a flat hand barely slides under. It takes under a minute and it is the whole game.

4 Hazard assessment: a real difference between 1926 and 1910

In general industry, 29 CFR 1910.132(d)(1) requires the employer to assess the workplace to determine whether hazards are present that necessitate PPE, and 1910.132(d)(2) requires a written certification of that hazard assessment identifying the workplace evaluated, the person certifying, and the date.

The construction standards contain no equivalent written-assessment clause. 1926.28(a) and 1926.95 require the employer to require and provide appropriate PPE, but they do not spell out a documented assessment. Many good contractors do one anyway — it is the only defensible way to answer "why this glove and not that one" — and multi-employer sites often demand it. A useful assessment walks the actual task, not the trade name. For each step: what could reach the eyes, the head, the hands, the feet, the ears, the lungs? What is the energy — impact, splash, heat, electrical, dust? What controls sit above PPE, and what is left after them? Then choose gear rated for the residual hazard.

5 Where the ratings come from

OSHA rarely describes the equipment itself. Instead the standards incorporate by reference consensus standards written by ANSI, ASTM and ISEA, and that is why the marking inside your gear matters as much as the standard number. Those documents are copyrighted and sold by their publishers, so this course names them and tells you what markings to look for, rather than reproducing their tables.

The practical rule: if the gear has no marking, you cannot show it meets anything. Unmarked "safety glasses" from a gas station, a bump cap sold as a hard hat, or a glove with no cut rating are all equipment you cannot defend after an injury.

6 Inspect, clean, replace

PPE degrades quietly. Ultraviolet light embrittles hard hat shells; solvents craze polycarbonate lenses; sweat and grit chew through harness webbing; earplug foam loses its rebound. The requirement in 1926.95(a) to maintain equipment "in a sanitary and reliable condition" is where all of that lives.

Build the checks into the same moment every day. Look at the shell and suspension of the hat for cracks, gouges, chalky surfaces and a suspension that no longer springs back. Look through the lenses toward a light for hazing and scratches in the line of sight. Look at glove palms for wear-through and at seams. Look at boot soles for embedded metal and separated welts. For anything used in fall protection, the inspection is required before each use under 1926.502(d)(21), and anything that took a fall comes out of service permanently until a competent person clears it.

When gear fails a check, the correct response is to remove it from service and get a replacement — which, under 1926.95(d)(5), the employer pays for.
