1.2 Trigger heights: 6, 4, 10 and 15 feet
"Six feet" is the answer most crews give, and it is right about half the time. On a scaffold the number is more than 10 feet. In steel erection it is more than 15. In a plant under 29 CFR 1910 it is 4. Reaching 10 inches below the surface you are standing on triggers it at any height, and stepping into a hole triggers it at no height at all. This chapter puts every trigger you are likely to meet in one place, with the paragraph that sets it, and explains why they differ.
1 The sentence everyone quotes
29 CFR 1926.501(b)(1): "Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems."
Three things about that sentence decide most arguments. It says 6 feet or more, so 6 feet exactly is in. It says shall, with no exception for how briefly you will be there or how careful you are. And it names three systems — guardrail, net, personal fall arrest — with no fourth option like "be careful" or "hold on."
"Unprotected side or edge" is defined in 1926.500(b): any side or edge of a walking/working surface where there is no wall or guardrail system at least 39 inches high. That definition is why a 36-inch parapet does not solve your problem and a 40-inch one might.

Two entries in that table catch experienced people out. The overhand bricklaying rule in (b)(9)(ii) has no height in it: reach more than 10 inches below the level you are standing on and you owe a guardrail, net or personal fall arrest system. And the dangerous-equipment rule in (b)(8)(i) is the only place in Subpart M where being less than 6 feet up creates a duty, because what is below you matters more than how far you would fall.
3 Construction versus general industry
The same worker, the same mezzanine edge, two different numbers. It is not an inconsistency anyone defends on the merits; it is history. Subpart M was written for construction in 1994. General industry's walking-working surfaces rules were rewritten much later, in OSHA's 2016 walking-working surfaces final rule, which replaced a patchwork of 1971-era provisions with 1910.28 for the duty and 1910.140 for the equipment.

The practical lesson: the duty heights differ, the equipment criteria have largely converged. If you are a contractor doing maintenance inside an operating plant, ask which standard the host applies. A 5-foot platform edge is compliant on a construction site and a citation in a general industry workplace.
4 Why the scaffold number is 10 and not 6
1926.451(g)(1) requires protection for each employee on a scaffold more than 10 feet above a lower level. It sits in Subpart L, not Subpart M, and Subpart L governs scaffolds by name. That is the whole explanation: when a specific subpart addresses the hazard, it controls.
But the scaffold rule is not simply "10 feet, any system." Which system you owe depends on the scaffold type, and several types require fall arrest regardless of what a guardrail could do:
- Boatswain's chair, catenary, float, needle beam and ladder jack scaffolds: personal fall arrest system.
- Single-point and two-point adjustable suspension scaffolds: both a personal fall arrest system and a guardrail system.
- Self-contained adjustable scaffolds: guardrail alone when the platform is supported by the frame; both systems when it is supported by ropes.
- Walkways within a scaffold: guardrail system with a top rail able to take at least 200 pounds.
- Overhand bricklaying from a supported scaffold: personal fall arrest or a guardrail on all open sides and ends, except at the wall being laid.
- Crawling boards: fall arrest, a guardrail, or a three-quarter-inch grabline beside each board.
- All other scaffolds: personal fall arrest or a guardrail meeting 1926.451(g)(4).
Note also 1926.451(g)(2): employees erecting and dismantling supported scaffolds must be provided fall protection where the employer determines it is feasible and does not create a greater hazard. That determination belongs to a competent person, and it is the paragraph inspectors reach for when a crew builds a frame scaffold with nothing on at all.
5 The steel erection numbers
Subpart R sets steel erection apart because the structure is the hazard and the protection at the same time. 1926.760(a)(1) requires protection for each employee on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level.
Connectors get their own paragraph. Under 1926.760(b), a connector must be protected from fall hazards of more than two stories or 30 feet, whichever is less, must have completed the connector training required by 1926.761, and — above 15 feet and up to that limit — must be provided with fall protection equipment and wear it whenever it is provided and can be used.
1926.760(c) allows a controlled decking zone where metal decking is initially being installed, over 15 and up to 30 feet above a lower level. The CDZ is bounded, no more than 90 feet wide and 90 feet deep, with unsecured decking limited to 3,000 square feet, and only employees trained for controlled decking zone work under 1926.761 may enter.
Finally 1926.760(e), the paragraph that resolves arguments between trades: fall protection installed by the steel erector may remain in place for other contractors only if the controlling contractor has inspected it, accepted control and responsibility for it, and directed that it remain.
6 How to answer the question on your own job
- 1Which standard covers this work? Construction Part 1926 or general industry Part 1910. Then: is there a subpart that names this activity — scaffolds, steel erection, cranes, ladders, tunneling, electric transmission?
- 2What is the exposure? Not just height. A hole, a wall opening, dangerous equipment below, a reach below the surface, an excavation edge — each has its own paragraph and its own trigger.
- 3What does that paragraph allow? Some situations name all three systems; some name only guardrails; some name only fall arrest. Chapter 1.3 walks 1926.501(b) line by line.
- 4Can you meet the criteria? The criteria live in 1926.502. An anchor you cannot certify at 5,000 pounds means the fall arrest option is not actually available to you.
- 5Write it down before the crew arrives. That written answer is the plan the CPWR data says is missing.
- Construction: 6 ft or more, 1926.501(b)(1). General industry: 4 ft or more, 1910.28(b)(1)(i). Scaffolds: more than 10 ft, 1926.451(g)(1). Steel erection: more than 15 ft, 1926.760(a)(1).
- "Unprotected side or edge" means no wall or guardrail at least 39 inches high — 1926.500(b). Measure the parapet.
- Two triggers have no height: stepping into a hole (1926.501(b)(4)(ii)) and reaching more than 10 inches below your surface in overhand bricklaying (1926.501(b)(9)(ii)).
- Being less than 6 feet above dangerous equipment creates a duty under 1926.501(b)(8)(i) — what is below you counts.
- Scaffold fall protection depends on the scaffold type: suspension scaffolds need fall arrest and a guardrail; boatswain's chairs, floats, needle beams, catenary and ladder jacks need fall arrest.
- The duty heights differ between 1926 and 1910; the equipment criteria — 5,000 lb anchorage, 1,800 lb, 6 ft, 3.5 ft — are the same in both.
