A compliant guardrail is 42 inches tall give or take 3, holds 200 pounds anywhere along the top edge without failing, does not drop below 39 inches while it holds it, and has a midrail at 150 pounds unless a 21-inch wall is doing that job. Everything else in 29 CFR 1926.502(b) is detail — and the detail is where crews get written up.
Every number in one table
These are the construction criteria in 1926.502(b), plus the toeboard figures from (j), which people routinely fold into the same conversation even though they belong to falling object protection.

39 inches is a deflection limit, not a height
Two different 39-inch figures live in the same paragraph and get mixed up constantly.
- 39 inches as a height is the bottom of the tolerance band in (b)(1). A rail built at 39 inches is legal on the tape measure.
- 39 inches as a floor under load is (b)(4): when the 200-pound test load is applied downward, the top edge must not deflect to a height of less than 39 inches.
Put those together and a rail installed at exactly 39 inches has no room to flex at all. Build to 42 and the tolerance is doing what it was written to do. The non-mandatory Appendix B to Subpart M lists constructions — wood, pipe, structural steel — that are deemed to meet the deflection requirement, which is the practical way out of testing anything.
The 200-pound figure is also a minimum capacity, not a design target. It is applied at any point along the top edge, which means the weakest span and the last post before an opening are the ones that decide whether the system complies.
The details that fail an inspection
- Banding used as a rail. Steel banding and plastic banding shall not be used as top rails or midrails — (b)(8). No exceptions, no matter how tight it is pulled.
- Rails overhanging the terminal posts. Prohibited by (b)(7) except where the overhang does not constitute a projection hazard. A 2x4 sticking three feet past the last post at head height is a hazard.
- Rough or splintered rails. (b)(6) requires the system to be surfaced to prevent punctures, lacerations and snagging of clothing. A rail nobody will grab is not doing its second job.
- Unflagged wire rope. Legal as a top rail, but only when flagged at 6-foot intervals with high-visibility material — (b)(9).
- Rope left up all season. Manila, plastic or synthetic rope used as a top rail or midrail must be inspected as frequently as necessary to confirm it still meets the 200-pound requirement — (b)(15). UV and weather are what that paragraph is about.
- An opening with nothing across it. Every removed section is an unprotected edge until it goes back.
Holes, hoist areas and ladderways
Four paragraphs cover the openings crews actually cut into a guarded floor, and each one has its own rule:
- Hoisting areas — a chain, gate or removable guardrail section goes across the access opening whenever hoisting is not taking place — (b)(10).
- Holes — guardrails go on all unprotected sides or edges — (b)(11).
- Holes used to pass materials — no more than two sides may have removable sections, and when the hole is not in use it is closed over with a cover or guarded on all sides — (b)(12).
- Holes used as points of access, such as ladderways — a gate, or an offset such that a person cannot walk directly into the hole — (b)(13).
Guardrails are also required along each unprotected side or edge of ramps and runways — (b)(14).
When a hole gets a cover instead of a rail, the cover has its own criteria in 1926.502(i): it must support at least twice the weight of the employees, equipment and material that could be on it at once, or twice the maximum axle load of the largest vehicle in a roadway or vehicular aisle; it must be secured against accidental displacement; and it must be color coded or marked "HOLE" or "COVER".
Scaffolds and general industry play by different numbers
Applying 1926.502(b) to everything with a rail on it is the most common way to be confidently wrong.

The trigger height differs too: fall protection is generally required at 6 feet over a lower level in construction under 1926.501(b)(1), and at 4 feet in general industry under 1910.28.
A guardrail is not an anchorage
The single most expensive misunderstanding on this subject. 1926.502(d)(23) states plainly that personal fall arrest systems shall not be attached to guardrail systems. The arithmetic explains why: a guardrail is built to resist 200 pounds, while a fall arrest anchorage must support at least 5,000 pounds per employee attached — or be designed by a qualified person as part of a complete system with a safety factor of at least two — under 1926.502(d)(15).
The choice between a guardrail and a personal fall arrest system is worth making deliberately in the job hazard analysis for the task. A guardrail is passive: nothing to inspect before each use, no rescue plan, no clearance to calculate underneath. A harness needs all three — and the fall clearance calculator will tell you within a minute whether the room below the anchorage is even there.
Bottom line
- 42 in ± 3 to the top edge, 200 lb anywhere along it, no deflection below 39 in under that load.
- Midrail midway at 150 lb, unless a wall or parapet at least 21 in high is already there. No opening over 19 in.
- Toeboards are falling object protection, not guardrail criteria: 3½ in, ¼ in gap, 50 lb.
- Scaffolds and general industry use different heights, forces and gate rules. Check which standard the work sits under before you quote a number.
- Never tie off to a guardrail — 200 lb of rail against a 5,000 lb anchorage duty.
